In Aranas v. Napolitano, an immigration-related class-action challenge to DOMA, a hearing was held on November 20 to address several motions filed by all the parties to the case: a motion for class certification, the same-sex couples’ motion for a preliminary injunction barring enforcement of deportation and other issues, and motions to dismiss. The Justice Department and the plaintiffs opposed the Bipartisan Legal Advisory Group (BLAG)’s motion to dismiss the case entirely, but the Justice Department also filed a request to stay the proceedings in the case in light of the Supreme Court’s actions in United States v. Windsor. A decision has not yet been issued on these pending motions, and now the plaintiffs have filed a request to the judge asking for one. The filing points out that it has been days since the hearing. The Justice Department, according to the filing, still wants the case put on hold until after the Supreme Court issues its decision in Windsor, sometime in late. The plaintiffs’ filing notes that BLAG was invited to join the request, but declined to do so.
